"Made in USA" is one of the most-regulated label claims in American commerce — genuinely stricter than most people assume, with real penalties for companies that get it wrong.
The Federal Trade Commission's Made in USA Labeling Rule (finalized in 2021, codified at 16 CFR Part 323) requires that for a product to carry an unqualified "Made in USA" claim, it must be "all or virtually all" made in the United States. This isn't a loose guideline — it's a specific legal standard with three core requirements:
The standard permits only a negligible amount of foreign content. The FTC considers factors including the proportion of total manufacturing costs attributable to US materials and labor, and how far removed any foreign content is from the finished product (raw materials sourced abroad are viewed differently than imported finished components).
This isn't a toothless rule: companies that violate the Made in USA Labeling Rule can face civil penalties exceeding $50,000 per violation, and the FTC has taken active enforcement action — including a case against a battery company that became the rule's first formal enforcement action, and warning letters sent to major online marketplaces in 2025 regarding third-party sellers' claims.
Companies that source some materials internationally can still make a "qualified" claim — for example, "Made in USA with globally sourced ingredients" — which is legally distinct from an unqualified "Made in USA" claim and doesn't require meeting the full "all or virtually all" standard. This is a meaningful distinction worth reading label language carefully for.
Many supplement companies source raw botanical or nutrient ingredients internationally (which is extremely common across the industry, since certain raw materials aren't domestically available at scale) while conducting manufacturing, encapsulation or bottling, and quality testing in the US. This is why many legitimate supplement companies use language like "manufactured in the USA" or "produced in a US facility" rather than an unqualified "Made in USA" claim — the distinction matters and reflects the more accurate legal reality of global ingredient sourcing.
LipoFlow is manufactured in a GMP-certified, FDA-registered US facility — we describe this as domestic manufacturing rather than making an unqualified "Made in USA" ingredient-sourcing claim, which is a more accurate reflection of how supplement ingredient sourcing typically works across the industry.
